It can't be easy for the companies who lose these cases, and I'm sure there will be those that question the efficacy of UK patent law, particularly in terms of the granting of patents which are so difficult to get round they may be close to becoming generic. However, the laws we have are the best/only way of preventing competitive anarchy, so can anyone complain too much about the execution of those laws, even if, at times, it seems an imprecise art which sees top High Court Judges disagreeing with each other over interpretation? |
